GigaRocket VPS Terms of Service
You MUST read and understand this agreement as you will be asked in your VPS account application to accept the terms and conditions of use of the VPS.
GigaRocket reserves the right to suspend, restrict or terminate any account where the account holder is in breach of this agreement.
Note that Games Servers are not allowed. GigaRocket has a strict policy against Games Servers and Games on all of our servers.
Our VPSs are given on a post to host principle. You have to make 25 quality posts in order to get a VPS. You also need to make a further 15 maintenance posts per month for continued use of the VPS. All of these should be non-spam posts - refer our Guidelines for Quality Posts and Forum Rules. For those who have little experience with managing a VPS we recommend that you apply for a shared hosting account first and take your time before you apply for a VPS.
Shared Hosting Account
Forum members are allowed a free shared hosting account in addition to a free VPS. You need to make 10 QUALITY posts in order to apply for a shared hosting account and 25 QUALITY posts for a VPS.
Should you have a shared hosting account in addition to a VPS account, any breach of the VPS agreement will also be considered a breach of your shared hosting agreement and vice versa. Therefore disciplinary action of any of the two will affect both accounts simultaneously. By accepting GigaRocket VPS Terms Of Service, you also affirm that you accept Free Web Hosting Terms & Conditions.
Posts for VPS Hosting
GigaRocket is a post for host Website. Members need to make 25 quality posts in our community forums before they may apply for a VPS. Once members have been provided with a VPS account we require our members to make a further 15 maintenance posts per month for continued use of the VPS account.
VPS hosting not suitable for beginners
Our GigaRocket VPS servers are Linux based, which means that users will require some basic knowledge of Linux commands. They also will need knowledge and experience of building and maintaining Websites. The VPS servers are therefore unsuitable for beginners who do not have a working knowledge of Linux commands. When our members apply for a VPS account we would like to see some maturity and experience of managing a hosting account. Hence why a shared hosting account is recommended before a VPS is applied for.
Kindly note that there will be no support services provided for VPS hosting other than the technical installation and setup of the VPS.
Limited Stock
GigaRocket has a limited stock of VPS servers available. So may not be able to provide a VPS server immediately on demand. Provision of the VPS server is solely at the discretion of the owner.
IP Usage
Dependent on which node your free VPS is allocated on you may receive an IPv4 / IPv6 IP address or even both.
VPS account must be active - implementation of 20 maintenance posts rule
As with shared hosting, the VPS account has to be active and used for the purpose of Website building. If there is any reason to believe the VPS is not actively used, then the service will be suspended. Failure to make the required 20 maintenance posts per month will be deemed to be a breach of this agreement and lead to immediate suspension of the account.
Only one VPS account is allowed
Each applicant is only allowed one free VPS hosting account. More than one hosting account is strictly prohibited. If you are found to have more than one account you will lose your account and be banned from the free services for life.
VPS Control PanelsUse of VPS Hosting Accounts and Backup of Files
Use of the VPS service is at your sole risk. GigaRocket is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on GigaRocket servers. We strongly recommend that you back up your files and database/s on a regular basis. GigaRocket will not be held responsible for data that has been lost.
Prohibited Use
GigaRocket prohibits the use of its VPS servers for:

If GigaRocket' staff team determines that an account holder is utilizing an unacceptable amount of system resources, other than allocated, GigaRocket may temporarily suspend the account until the source of the problem has been resolved.
GigaRocket will be the sole arbiter as to what constitutes a violation of this provision. Because of the nature of this provision, each account will be considered and analyzed individually.
Unsolicited Email (SPAM)
SPAMing, or the sending of unsolicited email, from a GigaRocket VPS server or using a return email address that is maintained on a GigaRocket VPS server is STRICTLY prohibited. We will be the sole arbiter as to what constitutes a violation of this provision. Sites found to be in violation of our SPAM policies will be immediately deactivated.
Server Abuse
Any attempts to undermine or cause harm to a GigaRocket VPS server or account holder of GigaRocket is strictly prohibited.
We will be the sole arbiter as to what constitutes a violation of this provision. Account holders found in violation of this provision will be subject to account deactivation!
Data Transfer (Bandwidth) and System Resources
All VPS hosting accounts should remain within the agreed data transfer (bandwidth) allowance for the account. In the event that an account is deemed to be using excessive data transfer (bandwidth) or resources, GigaRocket may suggest action to reduce bandwidth or resource use, or suggest moving to another hosting provider.
Failure to Follow Policies
Failure to fully comply with these terms is grounds for account suspension and/or deactivation. Any VPS accounts hosted by GigaRocket must comply to the above policies.
We reserve the right to remove any account without prior notice!
Liability
GigaRocket will not be responsible for any loss or damage to your Websites. GigaRocket makes no warranties, expressed or implied, for any services we offer.
Account holders shall indemnify and hold harmless GigaRocket from any and all demands, liabilities, losses, costs, and claims, including all legal fees, asserted against GigaRocket and its agents, customers, officers and employees, that may arise from any service provided or performed or agreed to be performed, or for any service offered by GigaRocket, its agents, customers, officers or employees.
GigaRocket will not be responsible for any loss or damage caused by infringement of copyright or proprietary rights, supply of defective goods or services, any loss or damage (personal or business), caused by members of GigaRocket.
Changes and Amendments
GigaRocket reserves the right to amend and/or to change these Terms and Conditions without notice.
